Chapter 7 bankruptcy is also called "liquidation" or "debt elimination". It erases your unsecured debts (credit cards, hospital bills, but rarely loans like Studen Loans, Home Loans or Auto Loans). The downside is that in some cases Chapter 7 Bankruptcy will require you liquidate or sell items you own to pay back your creditors.

The Chapter 7 bankruptcy process takes between four to six months, and costs less than $300 in filing and administrative fees. However, you will typically end up paying between $1,000 to $3,000 to hire an attorney to administer your bankruptcy, based on the complexities of your situation. You will usually only have to go to court once, but several attorneys do not require an in office visit. You can correspond and exchange the required documentation via phone, email and or fax.

Eliminating your debts through Chapter 7 Bankruptcy can sound like a relatively quick and easy fix, but not all qualify for Chapter 7 bankruptcy. If you have filed bankruptcy in the past 7 years, you do not qualify. The Duluth Bankruptcy court will also take into account your assets, income, ability to pay your outstanding debt back and may recomend Chapter 13 bankruptcy, which will stop creditor calls and harassment, but is a reorganization of debts (and corresponding interest rates) instead of a complete removal of all debts.
